council meeting. >> triple-digit heat over the last couple of days. cooler temperatures are on the way. we'll talk about that coming up. >> and we're watching a problem on 101 in san jose. we'll have details on that plus a check of bay area drive times. good morning. wednesday, october 3rd. i'm frank mallicoat. >> i'm michelle griego. time now is 6:00. we begin with a developing story from berkeley. firefighters are still on the scene of a duplex fire which started nearly 6 hours ago. >> cbs 5 reporter anne makovec is there and anne, we understand this was a pretty complicated fire for the crews to fight. right? >> reporter: it was challenging because the homes are so close together here on bienvenue avenue in berkeley. they did just reopen the avenue so that's some good news but firefighters still on scene watching for any flare-ups this morning. the fire started just after midnight and check out these pictures posted online overnight on the daily cal website showing how intense that fire became. five people were living in a

duplex. they all got out safely including a woman in a wheelchair who had to be helped out by police. four homes surrounding this one were also evacuated as a precaution. those people have been allowed back in except for the family of five that is homeless this morning. firefighters in the meantime are evaluating the damage. >> during the firefight, there was a collapse of the roof and second floor which resulted in us backing out of the building and fighting the fire defensively. this is where we put our ladder trucks and spray water from the temperatures to of the roof and hose lines into the windows -- water from the tops of the roof and hose lines into the windows. >> reporter: part of the roof collapsed falling on the first story. but firefighters pulled back before that happened. nobody was hurt. now, there was some talk that maybe a propane tank may have been involved in starting this fire. firefighters will not confirm that this morning.

they say once they're sure all the hot spots are out in this house, then they will start their investigation into the cause. live in berkeleys anne makovec, cbs 5. >> thank you. new this morning, more gun violence in san jose. police are investigating two late night shootings. a man was wounded near ezie and kass drive about 11:30 last night. 15 minutes later another man showed up at a hospital after he had been shot. both victims are expected to survive. no suspects so far. major disruptions at the oakland city council. the second time in two weeks it happened last night and cbs 5 reporter cate caugiran in oakland where i understand the issue is a deadly police shooting. cate. >> reporter: frank, that's right. that's why things got so heated and so emotional at last night's city council meeting. now, this group of protestors shut down the city council meeting -- [ signal breakup ] -- came back last night with a vengeance. >> reporter: protestors were

locked out. they came to speak out against the shooting of alan bluford, a teen they say was armed with a gun when miguel masso shot him dead. last night they were banned from sitting in the rafters and protestors claimed the city crushed their first amendment rights but city leaders say they put these in place for security reasons. >> i think it's a rule that's always been very clear that if the crowd is too large for the room, then you establish a secondary place where people can watch. >> there are open seats all over this room and they have these doors closed because they don't want us here. >> reporter: the protestors became quiet after the bluford family was given the police report regarding their son's death. the report is heavily redacted but the family says it proves despise initial reports alan bluford never fired a shot. now in terms of how the city plans to operate future city council meetings, they are not sure how they will handle them

from here on out. oakland officials are blast the in a new report of an officer-involved shooting. the court-appointed monitor checking police reform says police sometimes shoot at suspects even if there is no imminent threat. the monitor report says police investigations into the shootings often fell short with detectives expecting that they were justified a mystery in san jose. what happened to a biker who disappeared two weeks ago. family and friends held a vigil last night to pray for the safe return of 32-year-old eric dean garcia. he was last seen september 18th leaving a friend's house two blocks from his own home. he got a phone call, said he would be right back and left on his motorcycle, never returned. family members of two fishermen who disappeared sunday have found their bodies along of the san mateo county coast found separately near pidgeon point. the two men were not wearing life jackets when their boat capsized sunday morning. protestors plan to march in richmond this afternoon to demand safety improvements at

the chevron oil refinery. the refinery was the scene of an august fire that prompted 15,000 people to seek hospital treatment out of concern they breathed in toxic smoke. meanwhile the city council passed a resolution yesterday setting tougher requirements for chevron as it rebuilds the fire damaged crude unit. 6:05. a little check of weather and traffic and i'm told lawrence is tired of the heat so he is going to cool it down for us. >> wish i had that control. [ laughter ] >> it's just a few days of a heat wave so we can bear through it. today we are going to start to cool down the temperatures. the sea breeze is going to be kicking in. a little hazy out the door and fairly mild in many spots. 56 degrees in san jose. 66 right now in mountain view. and 56 degrees in san rafael. by the afternoon, that ridge going to weaken somewhat. and that means we are going to see a stronger sea breeze kicking in. that sea breeze likely to carry with it low clouds and fog. in fact the fog is just starting to make its way into the monterey bay bay area.

mid-90s inland. 70s and 80s around the bay. 60s and 70s out toward the coastline. this just the beginning of some much cooler weather maybe some rain too. we'll talk about that in a few moments. let's check the roads with elizabeth. >> we have been watching this problem on northbound 101 a slight location change approaching blossom hill road. so a car actually ran off the road. it is not blocking lanes but to retrieve the vehicle, they may have. an emergency vehicle may have to. so just a heads up northbound 101 approaching blossom hill. not seeing any delays though coming up from morgan hill. the rest of the south bay looks good, 280, guadalupe parkway, so far all delay-free throughout san jose. check of the east bay, 880 live look at the nimitz starting to get a little busy towards oakland airport. that is a look at southbound 880. those headlights are moving all the way down towards hayward. so far a pretty nice ride and mass transit continues to run with no delay. let's take a quick look at the bay bridge where so far no metering lights but i'm sure that will change here very soon because you can see we are starting to see some delays at

least in those outer cash lanes. that's a check of your "timesaver traffic." back to you guys. president obama and republican challenger mitt romney just hours away from their first face-to-face debate. >> cbs reporter bigad shaban has more on tonight's contest in colorado. seems like we have been waiting for a long time, finally here. >> reporter: yeah, frank and michelle, good morning to you. the economy is expected to be issue number one here at the debate hall at the university of denver, certainly both candidates seasoned debaters. while mitt romney has never been in a presidential debate before, he has been in 19 multicandidate debates during the republican primary. he has been here in the state since monday. the president is expected to arrive in colorado later this afternoon. the stage is built. the cameras are in place. and the candidates are in their final hours of preparation. >> governor, are you ready for tomorrow? >> i'm getting there. >> reporter: mitt romney grabbed a burrito.

on his break president obama did sightseeing to hoover dam. when they arrive at the university of denver tonight they will face a lot of questions about the economy. >> i'm not interested in creating democratic jobs or republican jobs. i'm interested in creating american jobs. >> reporter: tonight's debate will feature six 15-minute segments. the first three are devoted entirely to the economy. >> there doesn't seem to be a whole lot of opportunity. >> reporter: john quinn is one of those people who will be paying close attention to those first 45 minutes of the debate. he is about to lose his apartment after being unemployed for four months. >> i'm a college graduate. i had a steady career in telecom for over 12 years. i continuelook for work 7 days a week actually. it is the hardest unpaid job i have ever had. >> reporter: he wants to know what president obama and mitt romney will do for people like him. >> there's a lot of people who have been out of work for a long time who are not satisfied with the status quo with either party the way it is working. >> reporter: the final segments of debate will focus on healthcare. >> i want to repeal obamacare and replace it with something that will get the costs under

control. >> reporter: and the role of government. tonight's debate will be the first of three between the two candidates this month. as for the vice-presidential hopes of, frank and michelle, the hopefuls will face off in their own debate next week. >> is it make or break for either candidate? we know mr. romney of course is the incumbent so he has to be favored a little bit but romney has been practicing for months now and a lot of people think he comes off somewhat robotic and what not. is it a bigger night for him? >> reporter: you know, mitt romney himself has said this will be a critical moment in his campaign. both have been practicing using proxies to fill in for the opponents. the incumbent usually doesn't do well on the first debate. they say that's because the challenger is essentially elevated just from being on the very stage with the president for the first time the two

toll plaza where it's getting busy. delays now in the fastrak and cash lanes with the metering lights turned on. it's backing up beyond the first overcrossing in the distance at least 10 pushing 15 minutes already just to get you on to the bay bridge at 6:16 this morning. other bridges, the san mateo bridge, this actually looks pretty good. that's westbound 92 in the commute direction. only a 14-minute drive time out of hayward heading towards foster city and if you are coming towards the east bay, coming off of the high-rise, everything looks good in those eastbound lanes of 92. elsewhere to our maps, just getting word of a possible problem sounds like it's on the on-ramp westbound 4 at that a street on-ramp. there may be a smaller fender- bender. we are seeing delays through antioch. we are cruising with mobile 5 and kcbs is traveling eastbound lanes of 580 through the livermore valley. eastbound going against the commute that's fine problem-

free but look at these westbound delays through the altamont pass slow and go from tracy all the way towards the dublin interchange. and just a quick note. you think it's busy now? it's going to get really busy especially in san francisco this weekend. we have a number of things going on, fleet week, america's cup, street fairs, home games for giants, and the 49ers. so we'll be talking much more about this in the coming days. in the meantime, let's talk weather. traffic and weather together every 10 minutes. >> big changes between now and then and the weekend with all those events going on. the last couple of days have been spectacular. hot temperatures outside triple digits in the valleys, today we are starting to see some cooler weather. more of a sea breeze kicking in. mild to start out the day 50s and 60s now. by the afternoon, still staying hot in the valleys of. you will see mid-90s there but the triple digits are gone. a lot of 70s some 80s around the bay and out toward the coastline we may see a couple of patches of fog swinging in late in the day and, of course, that will help to cool down of the temperatures too. high pressure now beginning to

weaken. that sea breeze going to start to kick in especially throughout the day today ushering in more low clouds and fog in the coming days and some much cooler temperatures. a southerly surge of low clouds and fog at the coast today into the afternoon. then tonight it's going to surge back onshore and that will bring with it cooler weather ahead over the next couple of days maybe even below average on the weekend. numbers looking like this. 88 in morgan hill. 82 fremont. 60s and 70s at the coastline. still mid-90s in the valleys. and in the central bay temperatures up in the 60s and 70s. some eights in the north bay valleys. next couple of days those temperatures cooling off below average to a few more clouds over the weekend even a slight chance of rain as we head into next monday. back to you. >> thank you. well, it's never too late or apparently too early to start helping the environment. students at a school in hayward are dedicated to not only recycling at school but also

against the shooting of alan bluford the oakland teen who police say was armed when officer miguel masso shot and killed him. the blufords claim the city held back information about their son's death and they addressed the council last night. [ indiscernible ] >> miguel masso murdered alan bluford in cold blood and that you are covering up a racist murder. >> reporter: several of the family supporters chanted inside but things got quiet after the council's president gave the family the police report regarding their son's death. the family says it was heavily he had at this time but according to the report it proves that bluford never fired a shot despite the initial reports. the district attorney's office is still investigating this incident. now, this group we want to make note is the same group that shut down the city council meeting two weeks ago. live in oakland, cate caugiran, cbs 5. this all comes as a new report blasts oakland officials

over officer-involved shootings. the court-appointed monitor checking police reform says police sometimes shoot a suspect even if there is no imminent threat. the monitor's report says police investigations into the shootings often fell short with detectives expecting that they were justified. well, there is a good chance the as will be staying put in the city of oakland at least until 2018. the team right now in talks with the oakland-alameda county coliseum authority. they are trying to work out a new deal a five-year extension on their lease. "chronicle" is reporting as managing partner lew wolff says they are absolutely interested in a deal. it is the naked truth. some of people are fed up with public nudity in san francisco. there is a new proposal calling for fines against people who run amok without their clothes on. street fairs and parades would be the exceptions there. the fines would start at about $100 and are being considered by san francisco's board of supervisors. and i know when we moved here from boston, i had been around san francisco for years. my wife was taken aback by

that. >> i was a little taken aback a few months ago when i was downtown. >> the pride parade and bay to breakers and no clothing. >> all right. >> kind of interesting. >> speaking of... [ laughter ] it is going to start to cool down around the bay area. the sea breeze is kicking in. what a beautiful start to the day again. out over the bay waters nice and calm right now. looking toward the bay bridge, the temperatures starting tout very mild as well and numbers still well into the 60s in many spots into san jose 65 degrees. 6 livermore and 64 degrees in oakland, 63 in livermore. by this afternoon though the sea breeze kicks in. it will still be warm. 88 degrees in morgan hill. about 85 degrees in san jose. east bay temperatures up into the mid-90s in the hottest spots. but the triple digits are gone. then inside the bay, we'll find more of a sea breeze in the afternoon and these temperatures will be cooling down even maybe some patchy fog returning to the coastline. more on that coming up in a few

journal congressional connection. it shows the two candidates as you can see neck and neck 47% for each among likely voters that will polled nationwide. other recent polls have shown the president with just a narrow lead. bigad shaban has more in tonight's face-to-face encounter in colorado. what can we expect as far as the focus and format of tonight's debate? >> reporter: good morning. certainly the economy will be issue number 1 here at the debate hall at the university of denver. both candidates are obviously very seasoned debaters and while this will be the first presidential debate for mitt romney, he has gone through 19 multi-candidate debates through the republican primary. tonight there will be six 15- minute segments. half of the debates, 45 minutes, will actually be solely devoted to the economy. the last part of the debate will be split between look, the role of government and governing. >> how about the pre-debate atmosphere? i'm sure denver can't wait for this to go on tonight at 6:00.

>> reporter: certainly a lot of buzz, part of the highway will be shut down for about five hours today in anticipation of the debate. a lot of people here, this is a state that has about 8.2% unemployment. so they are hoping a lot of the focus will be about jobs and specifically what candidates hope it do to bring more jobs to the people here. we spent the day at a job employment center here in denver. we met a man 61 years old thought at this point in his career he would be retired with a house of his own. turns out he lost his job a few months ago and had to move out of his apartment and is in a homeless shelter so obviously there is a huge focus right now on people wanting to hear specifics. >> bigad shaban, thank you. >> you can see the debate live on cbs 5 at 6:00. it's an hour and a half. tune in. time now is 6:39. she was mocked for her weight in an email. how a tv anchor is turning the incident into a learning experience for others. >> it's getting a lot of chatter today. plus a close encounter with a

way, as well. plenty of sunshine, 80 degrees. around the country cloudy, houston. 84. 81 denver good flying weather could see some problems though into chicago and new york with the possibility of showers. around the bay today, not as hot, still a very nice day 85 degrees in san jose. going to probably watch these temperatures max out along the coastline in the morning and cooling in the afternoon with patchy fog making a return. mid-90s in the hottest spots inland and inside the bay, 60s and 70s. some 80s showing up in the north bay valleys. next couple of days, temperatures cool off back to normal through friday. then below normal as we head throughout the weekend. and there's a chance of showers as we look toward next monday. that's a look at weather. let's check traffic with elizabeth. >> we continue to check in on our network of traffic cameras across the bay area. here's one in the south bay a live look at 101 near tully. you can see there is some delay now getting on the freeway. headlights are moving southbound. so far everything looks okay but once again those metering lights are on getting on the freeway. elsewhere bay bridge is once again very busy this morning. they turned on the metering

lights just after 6:15. so yeah, this is what we're left with delays in cash and the fastrak lanes. it's backing up towards the foot of the maze so a good 15, possibly even up to 20 minutes now just to get you on the bridge. it's crowded up that incline section as well as you head towards treasure island. let's go our maps because i promised you we would talk about what we're expecting this weekend. very busy conditions, very crowd, especially along the waterfront part of san francisco. so this is just some of the different things that are going on saturday and sunday. we have america's cup, giants, 49ers game, hardly strictly bluegrass and a number of street fairs and festivals around san francisco. so america's cup actually the practice round kicked off yesterday. so we're already seeing delays by scott and marina green, embarcadero, marina boulevard already getting kind of backed up. so we'll have a little bit more traffic coming up, traffic and weather together every 10 minutes. back to you. >> thank you. a merger of cell phone companies in the news this morning. >> it is.

and here now to talk about that and much more is kcbs moneywatch reporter jason brooks. >> reporter: good morning. we first got word of this taking place yesterday. today it's confirmed. metro pcs getting togethe with t mobile the fourth largest in the company owned by deutsch telekom. it will take 64% of the new company give the remaining stake to metro pcs share holds and pay them $1.5 billion in cash with the 9.3 million prepaying customers of metro pcs, t-mobile is still the fourth place carrier but would be closer to third. sprint. big day for hewlett- packard's ceo meg whitman going before analysts this morning in san francisco giving her future strategy for the company. and it has to have some meat in there for investors to get excited. hp already going through a cost- cutting restructuring process that will involve 29,000 job cuts. the company coming off its worst quarter in its history.

the traffic flow. and they are going to get better. >> public transit is recommended for anyone planning to attend those events this week. it may be a good idea. well, we have a couple of dog dramas with happy endings, thankfully. >> yeah. >> sure to brighten up your morning. >> first up is susie who went for quite a joyride. she ran out on the road in providence, rhode island, got hit by a car and got trapped and stuck to the grill of a car. the driver didn't have a clue. drove another 50 miles until another driver said, hey, you got a dog on your grill and amazingly susie was nearly unscathed looking pretty good right there. and and almost similar tale but this one on the west coast 52-year-old gene says he drove from chino to camp pendleton monday more than 100 miles in 100-degree heat. he thought something was odd under the hood and when he checked, he was beyond shocked.

still on the scene of a dupx fire that started around we have an update on a developing story we have been following in berkeley. firefighters still on the scene of a duplex fire that started around midnight. >> cbs 5 reporter anne makovec joins us now with the latest. good morning, anne. >> reporter: investigators are here now trying to figure out how this fire started. you can see the home here behind me from the front it doesn't look that bad. most of the damage is to the back of the house here on bienvenue avenue. the fire broke out around midnight and you can see from these pictures posted on the daily cal website how intense it became. five people were living there. they all got out safely including a woman in a wheelchair who was helped out by police. four homes surrounding this one were also evacuated as a precaution. those people though luckily have been allowed back in. firefighters in the meantime still evaluating the damage to the original home. this is what the back of the house looks like. part of the roof and the second
